If you were convicted of a DUI/DWI and received from the court a restricted operator’s license, driving outside the parameters of that restriction could potentially result in a violation of Virginia Code §18.2-272. Just like a DUI/DWI conviction, this offense is a class 1 misdemeanor with tough penalties for those found in violation of the statute. As a class 1 misdemeanor, the maximum penalty ranges up to 12 months in jail and up to a $2,500 fine. In addition, the DMV will invoke a license suspension above that already imposed by the court for the DUI/DWI. You will also lose the benefit of the restricted operator’s license. If that isn’t enough, this code section also includes a penalty enhancement which can result in a felony charge where the individual has three prior convictions under this section within a 10 year period. Due to the nature of your DUI/DWI conviction, the court may have required you to have installed in any car you drive, the ignition interlock.
