While Virginia Code has several variations of Driving on a Suspended License, the most common provision can be found under §46.2-301. This section defines the offense as a class 1 misdemeanor. In the worst case scenario for this offense, it can carry up to 12 months in jail and up to a $2,500 fine. In addition to these penalties, the court can also impose an additional license suspension. The severity of this offense is compounded when this is not a first offense. For instance, Virginia Code mandates a 10 day jail sentence for third offenses of this code section.
