This statute found in Virginia Code §46.2-300 applies to individuals who have not obtained a license as well as individuals who are not currently lawfully licensed in Virginia. If you are new to Virginia, you may not realize that Virginia requires new residents to obtain a Virginia license within 60 days of moving to Virginia. It is also worthwhile to note that there are other exceptions to this statute, but it is important to understand them so as to not be found in violation. The penalty for a violation of this statute is a class 2 misdemeanor which can carry up to 6 months in jail and up to a $1,500 fine.
